TERMS AND CONDITIONS

1) Terms and Conditions / Disclaimer of Liability
The following rules apply to all services purchased through Metrolane, LLC, its website, mobile app, and/or affiliate selling partners, unless otherwise expressly stated on Metrolane, LLC website or in writing from an office of Metrolane, LLC. The Terms and Conditions and Disclaimer of Liability statements addressed herein may be altered, eliminated, or additional requirements added at the discretion of Metrolane LLC’s CEO.
2) Definition of the Metrolane, LLC service
Metrolane, LLC is a sales & communications platform that connects customers seeking transportation between two or more locations and third party, independent transportation service providers (hereafter referred to as, transportation service provider(s)) that operate services which meet those requests.
The services primarily offered and arranged by Metrolane, LLC are herein defined as intra-regional connections for the purpose of connecting to and from a scheduled intercity or interregional travel service at a travel hub location.
Metrolane, LLC acts as a third party to all transactions, enabling customers to request and reserve travel itineraries and transportation service providers to fulfill said requests for transportation. Metrolane, LLC is not an operator and serves only as sales agent to the transaction between the passenger and the transportation service provider.
Metrolane, LLC neither owns nor controls any transportation service provider which fulfills passenger transportation requests. These Terms and Conditions of Purchase apply to all purchases made through Metrolane, LLC and travel provided by transportation service providers.
3) Contractual Relationship between purchaser and Metrolane, LLC
When you make a reservation request through Metrolane, LLC, you enter into a contract with Metrolane, LLC for that request and you agree to be bound by its terms. The terms of your contract are set forth in: (i) your ticket, and (ii) these Terms & Conditions of Purchase ("Terms").
4) Contractual Relationship between purchaser and Transportation Service Providers
Trips marketed and sold by Metrolane, LLC are operated by transportation service providers.
The transportation service provider of your trip is generally disclosed during the Day Prior confirmation process of your trip via email and/or text, which takes place within 1 calendar day prior to your scheduled departure. For select services offered by partner transportation providers that are sold through Metrolane, LLC’s platform, the transportation service provider is mentioned both at the time of booking and on the customer’s email confirmation.
The transportation service provider(s) who operate the service sold on Metrolane, LLC’s website, mobile app, and its partner affiliate websites have their own carriage conditions. You may contact the transportation service provider directly if you have any questions or concerns. Transportation service providers are solely responsible for operating the trip and any damages or claims associated with the trip. Passengers should contact the transportation service providers directly for their terms and conditions.
In cases of conflict between these Terms and the terms and conditions of a transportation service provider related to a reservation, the more restrictive terms and conditions shall control.
Metrolane, LLC and the transportation service providers fulfilling service requests, will not refuse to provide transportation based upon race, color, national origin, religion, sex, or ancestry.
5) Confirmation Process of Reservation request
By visiting Metrolane, LLC’s website, mobile app, or affiliate partner sites and selecting an available trip, you are making a reservation request for transportation services.
The reservation request is not a confirmed itinerary.
Reservations are only activated and confirmed in the 24 hour window prior to your trip, when a communication from Metrolane, LLC to the customer designated during the checkout process discloses the transportation service provider which is scheduled to fulfill your transportation request.
When you make a reservation request through Metrolane, LLC, you will receive an receipt (email, mobile app or printed document) with the details of your requested itinerary.
It is your responsibility to check that all information on the booking confirmation is accurate.
If inaccurate, it is your responsibility to contact Metrolane, LLC to change your reservation. Transportation service providers have the sole discretion to accept and/or reject reservation requests.
6) Transportation Service Provider(s) Can Change After Confirmation
Metrolane, LLC may substitute or change transportation service providers as required by its operations at Metrolane, LLC’s sole discretion. You are advised to contact Metrolane, LLC near the date and time of your trip to learn the name of your transportation service provider.
7) Amendments to Terms & Conditions of Purchase
Metrolane, LLC may amend these Terms at any time, except as prohibited by law. Your purchases are governed by the Terms in effect on the date you purchased your ticket and on the date of travel.
Metrolane, LLC reserves the right to apply Terms retroactively where reasonably necessary for operational reasons and where the change in the Terms does not have a material negative impact on you.
No Metrolane, LLC or transportation service provider representatives, including employees and ticketing agents, have the authority to waive, modify or alter any provision of these Terms unless authorized in writing by a Metrolane, LLC corporate officer or an authorized designee.
8) General Information about the transportation service
A valid photo ID is required for you to show the driver to board the vehicle.
Bring a copy of the reservation email to the designated boarding location
We require you provide us with a contact number (preferably cell) so we can contact you in the event of a service disruption
Smoking is prohibited aboard all vehicles in accordance with Federal law.
A service animal, trained for the purpose of accompanying a special needs traveler, will be permitted to travel with the passenger at no additional charge. A pre-arranged noticeof this accommodation , provided during the reservation process, must be given at least 48 hours in advance of the departure date. No other animals are permitted.
Metrolane LLC and its transportation service partners shall not be liable for delays caused by accidents, breakdowns, road conditions, weather and other conditions beyond its control. Said parties do not guarantee to arrive at or depart from any point at a specific time.
The transportation service provider(s) contracted to fulfill your reservation request, reserve full control and discretion as to the seating of passengers and the right to change such seating at any time during the trip, provided; however, seating arrangements will be made without regard to race, color, creed, or national origin.
Metrolane, LLC and the transportation service provider, reserves the right, when operating conditions require, to transfer passengers from one vehicle to another en route.
Metrolane, LLC and the transportation service provider, reserve the right to refuse to transport a person a) under the influence of intoxicating liquor or drugs, b) who is incapable of taking care of him/herself (this does not apply to persons who are accompanied by an attendant or nurse), c) whose conduct is such or likely to be such as to make him or her objectionable to other passengers or prospective passengers, d) who refuse to permit a search of his or her person or property for weapons or who fails to provide positive identification upon request, e) presents an imminent danger to other passengers and/or representatives of Metrolane, LLC and/or its transportation service providers or f) or who refuses to comply with any lawful rule or regulation. Such persons may be removed from the bus at such place along the route as the driver and/or official representative of Metrolane, LLC may select. Metrolane, LLC and its transportation service providers shall not issue any compensation for passengers removed en route.
Guests must be at least 16 years of age or older to purchase travel on our website to attend one of our scheduled trips and tours. This purchase must be facilitated by an adult at least 18 years of age or older who has consented to this purchase. Purchasing travel with Metrolane, LLC on our website constitutes an agreement to these terms. Metrolane, LLC is not responsible for any fares collected if purchased by a minor without permission from their parent or legal guardian. We are also not responsible if the minor commits fraud or perjures him or herself in the process stating they are of the stated age and have the appropriate permission to make this purchase.
If traveling alone, to ride any trip offered and arranged by Metrolane, LLC and fulfilled by a transportation service provider, guests must be at least 16 years old. Guests under the age of 16 must be accompanied by a paying adult aboard the same bus and/or schedule. Please note that Metrolane, LLC will be released from any and all liability resulting from failure to refund any fares purchased by minors without expressed written permission to ride our service, and/or minors under the age of 16 who are not accompanied by an adult.
During times of heavy guest demand, Metrolane, LLC may elect to operate additional vehicles to accommodate our guests. These vehicles may depart at times other than the scheduled departure time, in the interest of our guests. The times listed on any of the schedules and/or itineraries displayed on the website for the purposes of guest convenience and operational planning and are subject to change at any time without prior notice.
Seating is limited and reservation access may be discontinued at any time prior
Unless otherwise stated, all reservation requests offered and arranged by Metrolane, LLC are one way trips.
When you register for a service operated and/or sold by Metrolane, LLC on its website or through its affiliate platforms, you agree to have your personal contact information added to our mailing list for promotional offers and any other communications as warranted by Metrolane, LLC. You may elect removal of your personal contact information from our mailing list by making a formal request via email to info (at) metrolane.net with a subject line of “(YOUR NAME) – Remove Personal Contact Information from Mailing List” and attaching a scanned/faxed image of your signature to the message with the date you wish this request to take effect. Only requests submitted with these requirements will be processed.
9) Reservations and Refund Policy
You must reserve and purchase your seat online through Metrolane, LLC’s website, mobile app and/or any third-party platform Metrolane, LLC approves and markets its services through to facilitate transactions. Unless duly noted and authorized by Metrolane, LLC under contract by its CEO, no other entities are allowed to facilitate such transactions.
By visiting Metrolane, LLC’s website, mobile app, or affiliate partner sites and reserving a specific travel service, you are making a formal reservation request for transportation services. The itinerary request is not a confirmed itinerary.
Reservations are only activated and confirmed in the 24 hour window prior to your trip, when a communication from Metrolane, LLC to the customer designated during the checkout process discloses the transportation service provider which is scheduled to fulfill your transportation request.
It is company policy NOT to accept walk-on, stand-by or cash fares at the departure point for any individual.
For purchases made directly through Metrolane, LLC’s website, mobile app or affiliate sales channel:
Except under the circumstances enumerated below, NO REFUNDS on reservation requests made through the Metrolane, LLC platform.
· Reservations may be changed up to 1 full calendar day prior to the scheduled departure date. Changes are defined as alterations to the time, date, origin, destination, and passenger contact information. Customers must follow the change request procedure below and fulfill all steps in order to process a change:
· Customer may use the reservation change booking tool on the Metrolane, LLC website or submit a change request email to info(at)metrolane.net at least one day prior to scheduled departure
· Customer must clearly choose (through website) or communicate (via email) the changes they wish to make to their reservation
· Customer may change the date of travel up to 180 days past the scheduled departure date into the future
· Customer must confirm email address to send reissued reservation
· Reservations are final and non-changeable after the 1 full calendar date deadline. Under no circumstance will change requests be honored within this time period with the sole exception of non-performance by a transportation service provider to fulfill the service requested by a passenger through their confirmed reservation, as issued by Metrolane, LLC.
· Any change made within this time period render the confirmed reservation null and void and a new reservation request must be initiated and paid for to reactivate the itinerary.
· Should a guest cancel their reservation with Metrolane, LLC, they must submit this request via email to info@metrolane.net. A reservation will only be cancelled once a cancellation number is issued to the guest via email. Once a reservation is cancelled, the seat(s) are forfeited and may not be reclaimed using that same reservation.
· At the discretion of Metrolane, LLC, refunds may be issued for the purchase price less transaction fees incurred under two instances: cases of non performance by the transportation service provider fulfilling your transportation request or inclement weather which prevents the transportation service provider from safely transporting you to your destination and back.
· With each circumstance, the company, Metrolane, LLC holds all rights to provide alternative means of compensation in lieu of a financial refund of the purchase price less transaction fees incurred, including, but not limited to the issuance of travel vouchers for future travel, and substitution of alternative event of equal financial value.
· If Metrolane, LLC cancels your scheduled trip for not meeting a minimum passenger quota, you will receive a full refund. All guests will be notified prior to a service cancellation of this policy.
10) Baggage
Customers are allowed one (1) luggage piece per person to stored in the transportation service provider’s vehicle luggage compartment and (1) carry-on luggage piece (personal item).
If space is available, a customer may purchase additional allowance for luggage. The minimum fee for each additional stored piece is $25 USD. The actual fee for additional stored luggage pieces is declared during the checkout process of your transportation request.
These personal items must be placed either in the overhead luggage compartment (if available), beneath your seat aboard the transportation service provider’s vehicle (if available), or on your lap or person. Your luggage is not allowed to take a seat away from a paying passenger. Metrolane, LLC and its transportation service providers do not allow the transport of weapons of any kind or any material that would be classified by the DOT as a hazardous material. (Acids, ammunition, animals, combustible liquids, compressed gases, corpses, cremated remains, explosives, firearms of all types, fireworks, flammable liquids, furniture, hazardous materials, poisons, radioactive materials, etc.).
The company requires each guest to carry their baggage aboard the vehicle. Metrolane, LLC and the transportation service provider are not responsible for lost, stolen, or damaged items as a result of you transporting them aboard our contractor’s vehicles.
This policy may be adjusted according to business needs. Should the baggage allowance change, affected customers will be contacted via email
11) Passenger Information
Metrolane, LLC may disclose the passenger’s personal information, including ticket and payment information, as required by law, upon order of the court, by request of a governmental agency, by request of a law enforcement authority, or in the good faith belief that disclosure is necessary or advisable.
Metrolane, LLC may also disclose personal information, but not ticket and payment information, to transportation service providers directly as required for them to fulfill a customer’s transportation request.
12) Passengers with Disabilities
Metrolane, LLC requires customers with disabilities inform the company of their needs during the transportation request process at least 48 hours prior to the departure date.
Reasonable commercial efforts will be made to accommodate customers with disabilities. Should Metrolane, LLC be unable to fulfill such requests, the customer will receive prompt communication via email and a full refund not to exceed the amount paid for their initial request.
13) Availability of website
We strive to keep www.metrolane.net available but are unable to guarantee that this website will operate continuously, without interruptions, or be error free and can accept no liability for its unavailability.
You must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other Internet connected device.
14) Links to other websites
Website links from www.metrolane.net and from company communications, including but not limited to referrals via email or phone, printed media and verbal communications exist for convenience and information.
Metrolane, LLC makes no representations regarding, or accepts any responsibility or liability for the products, services or information (or any reliance on it) contained on any such site. Metrolane, LLC does not guarantee that third party websites are free of infection from any virus, harmful component, or other code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, surreptitiously intercept or expropriate any system, data or personal information.
The existence of a link to another website does not imply or express endorsement of its provider, product or services by Metrolane, LLC.
15) Indemnification
You agree to indemnify, defend and hold us, our affiliates, distributors, partners, licensors, advertisers and sponsors, and our and their directors, officers, employees, consultants, agents and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise directly or indirectly out of or from (a) your breach of these Terms and/or (b) your activities in connection with the Services (including, without limitation, any and all purchases).
16) Disclaimer of Warranties
THE SERVICES, AND ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH NO WARRANTIES WHATSOEVER. METROLANE, LLC AND ITS LICENSORS EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. METROLANE, LLC AND ITS LICENSORS DISCLAIM ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SERVICES. METROLANE, LLC AND ITS LICENSORS DISCLAIM, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH THE SERVICES. METROLANE, LLC AND ITS LICENSORS DISCLAIM ANY WARRANTIES FOR SERVICES (OR GOODS WHEN PACKAGED WITHIN OUR SERVICES) RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED BY THE SERVICES.
YOU UNDERSTAND AND AGREE THAT YOU DOWNLOAD OR OTHERWISE OBTAIN MATERIAL OR DATA THROUGH THE USE OF THE SERVICES AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
17) Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL METROLANE, LLC OR ITS AFFILIATES, PARTNERS, ADVERTISERS OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF METROLANE, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE SERVICES, FROM INABILITY TO USE THE SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICES (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES (OR GOODS PACKAGED WITHIN THE SERVICE) RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE SERVICES, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE SERVICES. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE SERVICES (AND/OR GOODS WHEN PACKAGED WITHIN THE SERVICE), LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF THE SERVICES OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, THE SERVICES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.
Without limiting the foregoing, under no circumstances shall Metrolane, LLC or its affiliates, partners, advertisers or licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
The terms and conditions stated above will be governed under the laws of the United States of America and when applicable, the State of Texas. These terms are subject to change at any time, and the latest version available shall be applied to any and all issues pertaining to the agreement.
